Here at Flowmon Networks a.s. we take your privacy seriously. This Privacy Statement discloses our personal data practices, explains what type of information about you we gather, how we use them, process them and with whom we are sharing them.


Personal data

Personal data means any information about natural person that may be used to identify an individual, including, but not limited to, a first and last name, e-mail address, a home, postal or other physical address, other contact information, title, occupation and personal interest.

What personal data do we collect about you and how we use them?

We collect your personal information when you register for a Flowmon Networks account, when you use certain Flowmon Networks products or services, when you ask to be included in an e-mail or other mailing list, when you submit an entry for sweepstakes or other promotions, or when you submit your personal information to us for any other reason.

We may also collect certain information automatically from your device to administer our website. More specifically, the information we collect automatically may include information like your IP address, device type, browser-type, geographic location and other technical information. We may also collect information about how your device has interacted with our website, including the pages accessed and links clicked. Collecting such data enables us to better understand you, where you came from and what content of our website is of interest to you. 

From time to time we may receive your personal data from third party sources, including attendees list from trade events. We however make sure that these third parties either have your consent or are otherwise legally permitted or required to disclose your personal data to us. 

Registration

When you wish to download trial version of our product, enrol for a training or a webinar or simply register to our website we may ask you to provide your first name, last name, e-mail address, phone number and company name. We use this information in connection with your request and to communicate with you, based on a necessity for performance of contract or our legitimate interest. This information may also identify you when you visit our websites.

Providing support

We may use your personal information to support products or services you have obtained from us, such as notifying you of a product update or fix. We may combine your information with information from other interactions with you to provide you with more valuable suggestions in relation to product support.

We also provide “Flowmon Chat” sessions on our website to assist you while you are navigating through our sites. We will use personal information you provide in these sessions only for support provision in accordance with this Privacy Statement.

This processing is based on necessity for performance of our contract.

Marketing

If you wish to receive information about newest products, services, solution and events that we offer, you can subscribe to our newsletter. To provide you with these marketing information, we will need your e-mail address. You may at any time choose not to receive marketing materials from us by following the unsubscribe instruction included in each e-mail you may receive.

If you have previously rendered services or products with us we may send you commercial communication about related products and services we offer and which may complement your products portfolio, even if you have not specifically subscribed to our newsletter. If you wish further not to receive such marketing information, you can unsubscribe using any of above mentioned mean[s]. 

This processing is based on our legitimate interest.

Recruitment

In connection with a job application or inquiry, whether advertised on our website or otherwise, you may provide us with information about yourself, such as a resume. We may use this information in order to address your inquiry or consider you for employment purpose, i.e. in order to take steps at your request prior to entering into a contract. 

Browsing our website

When you browse our website, you do so anonymously, unless you have previously registered with us. We do log your IP address (the Internet address of your computer) to give us an idea of which part of our website you visit and how long you spend there. But we do not link your IP address to any other personal information unless you have registered with us. Like many other commercial websites, we use standard technologies, such as cookies and other HTML tools, to collect information about how you use the site to record that you opened an e-mail marketing message. This processing is based on our legitimate interest in the website operation, optimization and marketing.

Cookies

A cookie is a small data file that a site or its service provider transfer to your computer’s hard drive through your web browser that enables the sites or service providers to recognize your browser and capture and remember certain information from your previous visit. We use cookies to help us understand your preferences based on previous or current site activity. That way we can provide you with better experiences while browsing our website.

How we will use your personal data?

We only use your personal data to the service you have requested from us, as we have identified above, or for marketing purposes, as described above. We will only use this information subject to your instructions, data protection law and our duty of confidentiality.

Our work for you may require us to pass your information to out third-party service providers, subcontractors and other associated organisation for the purpose of completing tasks and providing services on your behalf. When we choose third party service providers, we make sure that they can provide the level of security to your rights that is necessary according to applicable law. We also disclose only the personal information necessary to deliver the services and we have contracts in place that requires them to keep your information secure and not use it for their own direct marketing purpose. 

Transfer of your personal data outside EEA

As part of the services offered to you through this website, the information which you give us may be transferred to countries outside of European Economic Area. This may be the case if some of our third-party providers is located outside of the EEA. If this is the case, we make sure that such provider ensures adequate level of protection to your personal data either by entering into standard data protection clauses adopted by the supervisory authority and approved by the Commission within the meaning of Article 46 of GDPR or by providing different appropriate safeguards pursuant to GDPR.

How long we will hold your data for?

We will retain your personal data for as long as is required to fulfil the purposes for which the information is processed or for other valid reasons to retain your personal information (for example to comply with our legal obligation, resolve disputes, or enforce out agreements).

Your rights

In connection to processing of your personal data you are granted with these rights:

  1. Right to withdraw consent to the processing of your personal data where the consent is a legal ground for such processing;
  2. right to access to your personal data that we hold about you and information about how we process them;
  3. right to correction of your personal data that we hold about you;
  4. right to completely delete all information that we hold about unless there is some other legal ground for their processing;
  5. right to receive the personal data which you have given to us, in a structured commonly used and machine-readable format and the right to transmit that data to another controller without delay form the current controller if the processing is based on consent or on contract and the processing is carried out by automated means;
  6. right to be informed about your personal data breach;
  7. right to lodge an objection of the processing of your personal data if you feel the “ground relating to your particular situation” apply. The only reason we will be able to deny your request is if we can show compelling legitimate grounds for the processing, which override your interest, rights and freedoms, or the processing is for establishment, exercise of defence of legal claims;
